Fatwa by: Muhammad bin Ismail bin Al Mughirah Al Bukhaari (Died 256 A.H.)
Question:
We know that there is no obedience to our family members in disobedience to Allah, but do we have to maintain ties of kinship with Non Muslim parents and family members?
Answer:
Islam enjoins maintaining good ties with parents and family members (ie brothers) who are Non Muslims.
Evidences:
Urwa related that Asma bint Abi Bakr said, "My mother (a polytheist) came to me while the Messenger of Allah, may Allah bless him and grant him peace, was alive, hoping for my favor. I asked the Messenger of Allah, May Allah bless him and grant him peace, "Shall I give to my mother?" He said, "Yes." (saheeh bukhaari)
Abdullah ibn Abbas reported that Abu Sufyan had told him that Heraclius sent for him and asked, "What does he, meaning the Prophet, may Allah bless him and grant him peace, command you?" He answered, "He commanded us to pray, give sadaqa, be chaste and maintain ties of kinship." (saheeh bukhaari)
Abullah ibn Dinar said, " I heard Ibn Umar say, " Umar saw a silk robe being sold and said, "Messenger of Allah, buy this and wear it on Friday and when delegations come to you." He said, "This is worn by the one who has no share (in the next world)." The Prophet, may Allah bless him and grant him peace, was brought some robes like that and he sent a robe to Umar who said, "How can I wear it when you said what you said about it?' He said, "I did not give it to you so that you could wear it, but for you to sell or to give to someone else to where." Umar sent it to a brother of his among the people of Makkah before he had become a Muslim." (saheeh bukhaari)
